Iowa’s winter moratorium on utility disconnections to end April 1, 2021

Iowa’s annual winter moratorium regarding utility service disconnection ends April 1, 2021. The Iowa Utilities Board (IUB) reminds energy assistance customers currently protected from service disconnection for nonpayment to contact their local utility company immediately to discuss payment plans options and avoid disconnection as soon as April 2.
 
Under Iowa’s winter moratorium law, customers who qualify for the Low-Income Home Energy Assistance Program (LIHEAP) or Weatherization Assistance Program are protected from the annual shutoff of natural gas and electric service from November 1 to April 1.
 
To avoid disconnection, Iowa customers who have fallen behind on utility payments are encouraged to review the customer rights and responsibilities information for electric and natural gas service and contact their utility provider to arrange a payment plan. If customers are experiencing difficulty paying their energy bills, they may be eligible for LIHEAP financial assistance and should contact their local community action agency to apply for assistance before April 30.
 
The LIHEAP program pays only a portion of utility bills to qualified low-income customers. Customers who are not sure where to apply can visit https://humanrights.iowa.gov/dcaa/where-apply.
In addition to the funding annually available through LIHEAP, an additional utility bill assistance program through the Iowa Finance Authority’s Rent and Utility Assistance Program is expected to become available this spring for Iowans impacted by COVID-19. However, Polk County residents should visit https://www.impactcap.org/ regarding updates to rental and potential utility assistance.
All utility customers, including those who do not qualify for energy assistance, may be eligible to enter into a reasonable payment agreement with their utility company that allows them to pay accumulated debt over time and to maintain utility service.

If customers cannot reach a payment agreement with their utility, they may contact the IUB Customer Service toll-free at 877-565-4450 or email customer@iub.iowa.gov with questions about disconnection, or other issues that are not resolved directly with their utility company.

Winter Moratorium Extended to May 13 for Disaster Areas

The Iowa Utilities Board (IUB) has extended the Winter Moratorium for Natural Gas and Electric Customers from April 1, 2019, to May 13, 2019.

The IUB order (DOCKET NO. SPU-2019-0005) comes in response to Governor Kim Reynolds’ proclamation of public health disaster emergency due to continued widespread flooding and flash flooding impacting large portions of Iowa.

Iowa Code § 476.20(2) establishes a moratorium from disconnection of natural gas and electric customers who are eligible for low-income home energy assistance or weatherization assistance programs between November 1 and April 1. The IUB adopted rules at 199 IAC 19.4(17) for natural gas service and at 20.4(17) for electric service that provide: “No disconnection may take place from November 1 through April 1 for a resident who is a head of household and who has been certified to the public utility by the local community action agency as being eligible for either the low-income home energy assistance program or weatherization assistance program.”

The extension to May 13, 2019, will apply to only those previously certified low-income individuals in counties that have been declared disaster areas who could be subject to possible disconnection on April 1, 2019.

The IUB order links the moratorium extension to STATE (Governor) disaster declarations and not to FEDERAL (Presidential) declarations. To read the order, go to:

IAMU and the IUB understand that not all member utilities in the counties included in the state declaration have been impacted by the effects of the flooding, but all member utilities in those counties included in the state declaration must adhere to the order. The order accounts for potential future flooding that could occur over the next six weeks during the continued seasonal thawing and rain.
