Iowa’s winter moratorium on utility disconnections to end April 1, 2021

Iowa’s annual winter moratorium regarding utility service disconnection ends April 1, 2021. The Iowa Utilities Board (IUB) reminds energy assistance customers currently protected from service disconnection for nonpayment to contact their local utility company immediately to discuss payment plans options and avoid disconnection as soon as April 2.
 
Under Iowa’s winter moratorium law, customers who qualify for the Low-Income Home Energy Assistance Program (LIHEAP) or Weatherization Assistance Program are protected from the annual shutoff of natural gas and electric service from November 1 to April 1.
 
To avoid disconnection, Iowa customers who have fallen behind on utility payments are encouraged to review the customer rights and responsibilities information for electric and natural gas service and contact their utility provider to arrange a payment plan. If customers are experiencing difficulty paying their energy bills, they may be eligible for LIHEAP financial assistance and should contact their local community action agency to apply for assistance before April 30.
 
The LIHEAP program pays only a portion of utility bills to qualified low-income customers. Customers who are not sure where to apply can visit https://humanrights.iowa.gov/dcaa/where-apply.
In addition to the funding annually available through LIHEAP, an additional utility bill assistance program through the Iowa Finance Authority’s Rent and Utility Assistance Program is expected to become available this spring for Iowans impacted by COVID-19. However, Polk County residents should visit https://www.impactcap.org/ regarding updates to rental and potential utility assistance.
All utility customers, including those who do not qualify for energy assistance, may be eligible to enter into a reasonable payment agreement with their utility company that allows them to pay accumulated debt over time and to maintain utility service.

If customers cannot reach a payment agreement with their utility, they may contact the IUB Customer Service toll-free at 877-565-4450 or email customer@iub.iowa.gov with questions about disconnection, or other issues that are not resolved directly with their utility company.

Applications begin November 1 for Low-Income Home Energy Assistance Program

Iowa Utilities Board encourages LIHEAP qualified customers to continue paying toward monthly energy bills during winter moratorium
  
(Des Moines) – The Iowa Utilities Board (IUB) reminds Iowans that limited financial heating assistance is available to income-eligible utility customers through the Low-Income Home Energy Assistance Program (LIHEAP). The general application period runs from November 1, 2020, through April 30, 2021. Early applications began October 1 for households that have a resident who is 60 or older or disabled, or in cases where disconnection is imminent. The IUB encourages anyone facing difficulty in paying their utility bill to contact their local community action agency or their local utility company.
 
The LIHEAP program is designed to help low-income homeowners and renters pay a portion of their primary home heating costs through a one-time payment made directly to the utility or heating fuel vendor. Eligibility for the federally funded program is based on household size and income, type of fuel, and type of housing. Funding for LIHEAP and the Weatherization Assistance Program is limited. Applicants qualified for LIHEAP or the Weatherization Assistance Program are protected by Iowa law from being disconnected from natural gas or electric service during the moratorium period of November 1 through April 1. However, the IUB urges all LIHEAP-certified customers to continue paying toward their energy bills through the winter to avoid accumulating high debt.

IUB order directs phasing in disconnection of utility service, modifies March 27 order

In connection with the May 27, 2020, expiration of Governor Kim Reynolds’ proclamation that eases restrictions and permits the reopening of some businesses, the Iowa Utilities board (IUB) today issued an order that establishes requirements that Iowa utilities must follow before they can resume disconnections of customers’ utility service.

Today’s order provides that municipal utilities providing electric and natural gas service and electric cooperatives may resume the disconnection of gas or electric service, subject to conditions and requirements, on or after May 28, 2020.The order allows investor-owned utilities that are rate-regulated by the IUB to resume the disconnection of natural gas, electric, and water service, subject to conditions and requirements, on or after July 1, 2020.

The conditions and requirements in today’s order establish a phase-in approach to disconnections and give customers time to contact a community action agency or other organization for available assistance if needed. In addition, the phase-in will allow customers who have been affected by the COVID-19 pandemic and who may not be familiar with the IUB’s disconnection process time to seek financial assistance from or enter into a payment agreement with the utility.

In order to initiate the process for the disconnection of a customer, the utility must comply with the IUB’s current disconnection rules. If the utility has previously provided a 12-day notice prior to May 21, 2020,it must provide an additional seven-day disconnection notice and contact the customer by telephone or door hanger 48 hours prior to date of disconnection. The telephone contact must be to a person in the residence and not to a messaging device.

In addition, each customer subject to disconnection must be allowed a 30-day extension of disconnection for any special health condition,pursuant to IUB rules,and if either of the following conditions applies:

  • The customer has a health condition that requires the use of electric or natural gas service. The utility may request verification of the health condition.
  • The customer or a member of the customer’s household has tested positive for COVID-19. The utility may require verification of the test. The 30-day extension must be extended if the customer, or a person in the household, is still under COVID-19 quarantine at the end of the original 30-day period.

Investor-owned electric, natural gas, and water utilities are subject to the same disconnection requirements set out for municipal electric and natural gas utilities and electric cooperatives. In addition, an investor-owned utility may decide to waive some portion, or all, of a customer’s past due amount, or enter into an alternate payment agreement for the past due amount. If an investor-owned utility waives a portion of a customer’s past due bill, the utility may include those amounts in a regulatory asset account approved by the IUB.

Income-eligible Iowans may continue to apply for the Low Income Home Energy Assistance Program (LIHEAP) program through the extended deadline of June30, 2020, as approved by the Iowa Department of Human Rights.

Customers who are unable to reach a resolution with their utility may call the IUB at 877.565.4450 (toll-free) or 515.725.7300 or email customer@iub.iowa.gov. Any customer who has a complaint about utility service and is unable to resolve the issue with their utility may use the IUB online complaint form to file a complaint with the IUB.

COVID-19 winter moratorium extension ends May 27

On April 27, 2020, Governor Kim Reynolds signed a new proclamation extending the public health emergency to May 27, 2020.The Iowa Utilities Board issued an Order on March 27, 2020,that restricted the disconnection of utility service to any customers by all electric and natural gas utilities, including municipal, cooperative, and investor-owned, and all investor-owned water utilities until the public health emergency is lifted by Gov. Reynolds. The order also strongly encouraged all water utilities to cease shutoffs of service for the duration of the COVID-19 public health emergency.

The order issued by the IUB on March 27 is tied to the Governor’s proclamation and therefore, extends the winter moratorium until May 27, 2020.

The IUB originally extended the winter moratorium to May 1, 2020, by an emergency order on March 13, 2020, in Docket No.SPU-2020-0003. The order directed all electric and natural gas utilities to cease disconnection of residential service due to nonpayment for Low Income Home Energy Assistance Program (LIHEAP) qualified customers. The emergency order was in response to a statewide disaster proclamation issued by Gov. Reynolds on March 9, 2020.Thousands of Iowans have been impacted by the coronavirus outbreak and customers may be struggling to pay utility bills during the pandemic. The IUB urges customers to contact their local utility to discuss a payment arrangement. Customers seeking LIHEAP financial assistance for utility bills, should contact their local community action agency to discuss eligibility. The IUB continues to encourage all customers to continue paying toward their energy bills to avoid accumulating high debt and avoid facing utility service disconnection as the moratorium ends on May 27, 2020.

Income-eligible Iowans typically have until April 30 each year to apply for limited financial heating assistance through the LIHEAP program. The application deadline was extended to May 31, 2020, this year by the Iowa Department of Human Rights (IDPH).
